Terms of Service

Board Whisper (“Board Whisper”, “we”, “us”) is an AI coaching service for skateboarders, surfers and snowboarders. By creating an account or uploading a clip, you agree to these Terms of Service (the “Terms”). Board Whisper is only available to riders aged 16 or older. By registering, you confirm that you are at least 16 years old. We verify date of birth at signup and reject accounts that do not meet this threshold. If we discover an account belongs to someone under 16, we will delete it without notice.

You are responsible for keeping your password confidential and for all activity on your account. Tell us immediately if you suspect unauthorised access. You may close your account at any time from your profile settings - closure deletes your personal data subject to the retention rules in our Privacy Policy.

You can upload short video clips of yourself riding for AI analysis. By uploading, you confirm that:

• you are the rider in the clip, or you have permission from the rider;
• everyone visible in the clip is 16 or older;
• any other identifiable person in the clip has given their consent to appear;
• the clip does not contain unlawful, harmful or third‑party copyrighted material;
• you grant Board Whisper a limited, revocable licence to process the clip for the sole purpose of generating your coaching feedback.

We do not use your clips to train third‑party AI models, and we do not sell or share them with advertisers.

Board Whisper uses AI to analyse body position, balance and trick mechanics from your video. Feedback is best‑effort and provided for informational and entertainment purposes only. It is not professional instruction, medical advice or a substitute for a qualified human coach. You ride at your own risk and are responsible for your own safety, equipment and choice of terrain.

You agree not to:

• upload content of anyone under 16, or anyone who has not consented;
• upload illegal, abusive, hateful, sexual or dangerous content;
• attempt to reverse‑engineer the AI, scrape the service, or bypass rate limits;
• use the service to harass, defame or impersonate others.

We may suspend or terminate accounts that breach these rules, and we may report unlawful activity to the relevant authorities. Where we terminate your account other than for cause, you have 30 days after notice to request an export of your data before it is deleted.

To keep Board Whisper free and to protect it from abuse, we apply daily fair‑use limits per signed‑in account, per browser and per network on uploads and chat with the coach. We may also pause AI calls service‑wide for the rest of the day if total AI costs cross an internal safety threshold; service resumes automatically at 00:00 UTC. Limits and thresholds may change as the product evolves.

For logged-in riders, uploaded clips and their AI analyses are kept for as long as your account is active, so you can revisit your progress over time. You can delete any session at any moment from your library, and removing your account erases them all. Anonymous “try a clip” uploads expire within 25 hours.

Board Whisper is currently free to use. If we introduce paid plans, we will notify you in advance and require your explicit acceptance of the price and billing terms before any charge is made.

For any future paid digital service, EU consumers have a 14‑day right of withdrawal under Directive 2011/83/EU. Because the AI coaching feedback is generated immediately on demand, by starting a paid analysis you will expressly request immediate performance and acknowledge that you lose the right of withdrawal once the analysis has been generated.

You keep all rights to your own footage. Board Whisper keeps all rights to the service, the brand, the AI prompts, and the coaching framework. Nothing in these Terms transfers ownership of either party’s intellectual property.

If you believe content on Board Whisper infringes your copyright, send a takedown notice to [email protected] identifying the work, the location of the allegedly infringing content, and a good‑faith statement of ownership. We will review the notice promptly and inform the uploader, who may submit a counter‑notice.

Board Whisper is a beta product offered “as is” and “as available”. We do our best to keep it useful and online, but we don’t make warranties of any kind - including fitness for a particular purpose, uninterrupted uptime, or that the AI feedback will always be accurate. Features may change as the product evolves.

The AI can get things wrong. Tips, scores and progressions are informational only - you decide what tricks to try, what gear to wear and what terrain to ride. We’re not responsible for injuries sustained while skating, surfing or snowboarding, or for indirect or consequential losses arising from your use of the service.

Where we are liable, our total liability for any claim relating to the service is capped at the greater of (a) the amount you paid us in the 12 months before the claim, or (b) €50.

Nothing here limits liability that can’t be limited by law - for example gross negligence, wilful misconduct, death or personal injury caused by our negligence, or your statutory consumer rights.

Neither party is liable for failure or delay in performance caused by events beyond its reasonable control, including outages of third‑party infrastructure, internet failures, natural events, government action, or other circumstances of force majeure.

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with our Privacy Policy, form the entire agreement between you and Board Whisper regarding the service and supersede any prior agreements on the same subject.

We may update these Terms from time to time. When we do, we’ll update the version number and ask you to re‑accept them on your next session. Continued use after acceptance means you agree to the new version.

These Terms are governed by the laws of the European Union member state in which Board Whisper is established. Disputes will be handled by the competent courts of that jurisdiction. Nothing in this clause deprives you of the protection of mandatory consumer protection rules of the country in which you habitually reside.
